MINUTES OF THE PUBLIC MEETING OF OCTOBER 26TH, 2004
HANSON TOWN HALL, LIBERTY ST., HANSON, MA


Called to Order:  7:30 PM under the M.G.L. Chapter 131, s.40 and the Hanson By-Law 1-13, s.5.  by Philip R. Lindquist, Chairman in Meeting Room A in the Town Hall.

The minutes of October 12th, 2004 were postponed until November 9th, 2004  

Public Hearings

7:45 PM Notice of Intent for the upgrade of a septic system at 61 Ocean Ave., Assessor’s Map 2, Lot 1506 & 1507 for Margaret Kibler represented by John W. Delano & Associates, Inc., 220 Hudson St., Halifax, MA  02338.  (DEP #175-___)  (New Hearing)

Ron Grattan read the public hearing notice and the green cards were checked.  John Delano attended along with Steve Nicoletta who has a signed a purchase and sales on the property in question.  Mr. Delano made the presentation for a septic upgrade.  The system has been Board of Health and DEP approved with variances.  The old cesspool will be removed and disposed of offsite.  The new septic is a jet system.   Ms. Delaney commented that the wetland line is accurate.   Also, the proposal is an improvement over the old system.  Phil Lindquist read the abutters list. Those present were:

Dean Anderson, 62 Ocean Ave.:  Mr. Anderson asked why the applicant was not required to notify abutters across the pond as he had to do with his filing.

Ms. Delaney read the M.G.L. regulation and the Hanson by-law.  The wording was somewhat ambiguous and needs to be clarified.  However, Mr. Delano said to avoid a conflict he will notify any additional abutters across the lake.

Motion to continue until Nov. 9th, time TBA pending the receipt of a DEP#, notification from the Natural Heritage of F & W and additional abutter notification:  Ron Grattan

8:30 PM  Notice of Intent for the extension of recently approved Deerhill Road including the construction of Fawn Lane creating 10 new residential lots.  Also, the installation of all necessary drainage, utilities and site grading for the creation of the new roadways.  Map 102, Lots 7 & 18A-4 for A.W. Perry South, Inc., 20 Winthrop St., Boston, MA  02110 represented by Merrill Associates, Inc., 427 Columbia Rd., Hanover, MA  02339.  (DEP #175-___)  (New Hearing)   

Sean Chrisman read the Public Hearing Notice and the green cards were checked.  Peter Palmieri of Merrill Associates made the presentation.  Also attending were Richard Beal of A.W. Perry South, Paul Gallagher of JP Gallagher Construction and Bob Gray, Wetland Scientist for Sabatia, Inc., who did the wetland delineation.    The proposal is for a roadway and the creation of nine new residential building lots as well as two detention basins.  No work is proposed within the 50-foot buffer zone, however there will be individual filings for certain lots.  The wetland line is scheduled for review on Saturday, October 30th at 8:30 AM.  Ms. Delaney submitted a draft letter with a list of comments regarding the filing.  Among her suggestions were:  the submittal of an up-to-date NOI form, the submittal of a more detailed Operations and Maintenance Plan and revised plans.    In addition, the Commission has submitted a Rare Species form to Natural Heritage of Fisheries and Wildlife and is awaiting a reply.  Phil Lindquist read the abutters list.  Those present were:

Anne Keane, 0 Rear of Franklin St. -  No questions.  Explained that this was her son’s property.  It has natural springs.  20-30 years ago, the Government had it surveyed.  After the brook, the land goes uphill.  The highest points are in that area (where development is).  *Ms. Delaney asked if Bob Gray had acquired permission from the owners to access the property for the delineation.  Mrs. Keane gave verbal approval.
Melody Lindsay, 1135 Whitman St. –  Mr. John Aiello representing Ms. Lindsay asked who was reviewing the line on Saturday.  *He was informed that it was Dr. Walter Hewitson and Paul Gray.

Ms. Delaney reiterated that before a decision is made the Commission will need the Wetland line reviewed and a response to the letter in it’s entirety.

Appointments

8:00 PM  Appointment with Ed Johnson and residents of Joshua Lane to discuss Requests for Certificates of Compliance and the riverfront issues for:   8 Joshua Lane, Lot 11 (DEP #175-319), 10 Joshua Lane, Lot 12  (DEP #175-320),      7 Joshua Lane, Lot 13 (DEP #175-316), 4 Joshua Lane, Lot 9 (DEP #175-314),   6 Joshua Lane, Lot 10   (DEP #175-315)

Ms. Delaney had inspected the properties in question and found that the residents had been mowing the grass in the riverfront area beyond the markers.  Mr. Bernard Munro of Land Planning, Inc. attended with Ed Johnson, original applicant for the development and presented a map of existing conditions before any construction took place.  Allegedly, before the development, there were gardens and a sod farm and the residents are mowing grass that has been there historically.   Ron Grattan feels that the lots were divided up with the condition that there would be no work in the Riparian Zone.  Mr. Lindquist said that with conflicting information, we would have to research the files and minutes to see what was said at the original hearing.

Comments from agent regarding 16R School Street (DEP #175-302) – Ms. Delaney had inspected per request of the Commission to follow up on the construction of a pier/dock.  The owner says it is 50-years old and it was discussed at a hearing.  She can produce pictures.  More research is needed.

Memo to Board of Selectman regarding agent’s comments on Chapter 61A Land on Main Street – reviewed
Letter to John McEwan, Superintendent of Schools re:  WHRHS project – The Commission reviewed the agent’s letter regarding extra expenses to be incurred for what was, in effect, non-compliance of the Orders of Conditions.  The Contractor’s should post bond money and be held accountable for restoration of disturbed areas and oversight of the mitigation plan, not the Town. The Commission approved sending the letter.
